Police arrest man for violation of new DWI license suspension statute

The following items were recently released by the Barnegat Township Police Department:

Friday, Dec. 30: At 10:33 p.m., Ptl. Alex Hoffman arrested
Herbert Wills III, 19, of Barnegat for possession of marijuana under 50 grams and possession of drug paraphernalia after stopping Wills's car for failing to
maintain lane of travel in the area of Barnegat Boulevard and West Bay Avenue.

During the stop, Ptl. Hoffman discovered a quantity of marijuana and a smoking pipe in the vehicle.

Wills was charged with possession of marijuana under 50 grams and possession of drug paraphernalia. He was also issued motor vehicle summonses for possession of CDS in a motor vehicle and failure to maintain lane.

Wednesday, Jan. 4: At 7:55 p.m., Ptl. Richard Carr arrested Robert
Heimall, 47, of Barnegat for DWI after stopping Heimall's vehicle in connection with an investigation concerning domestic violence.

Heimall was charged with DWI, refusal to submit breath tests, reckless driving, failure to produce documents, and failure to wear seat belt.

Sunday, Jan. 8: At 9:12 p.m., Ptl. George Martin arrested John Sharpe Jr., 27, of Barnegat for operating a motor vehicle during a period of license suspension for DWI.

The offense (2C:40-26) is a new fourth degree crime which became law in August of 2011. The statute makes it a crime to operate a motor vehicle with a suspended license under certain conditions if the license suspension was issued as a result of a conviction for driving while intoxicated.

Ptl. Martin came into contact with Sharpe Jr. while investigating a suspicious vehicle complaint on Route 9 in the area of Bay Avenue.

Sharpe Jr. was lodged in the Ocean County Jail in default of $5,000 bail.
